These Terms should be read together with our:

2. Eligibility to Use the Website

You must be at least 18 years old, or the age of legal majority in your
place of residence, to place an order in your own name.

If you are under the applicable age of majority, you may only use the
website and place an order with the involvement and permission of a
parent or legal guardian.

By placing an order, you confirm that:

  • You are legally capable of entering into a binding contract;
  • The information you provide is accurate and complete;
  • You are authorised to use the selected payment method; and
  • You are purchasing products for lawful purposes.

3. Changes to These Terms

We may update these Terms from time to time to reflect changes to our
business, website, products, service providers or applicable laws.

The Terms that apply to an order are those displayed on the website at
the time the order is placed.

Updated Terms will be published on this page with a revised
“Last updated” date. Material changes may also be communicated through
the website or by another appropriate method.

4. Website Availability

We aim to keep the website available and functioning correctly, but we
do not guarantee uninterrupted or error-free access.

We may temporarily suspend, restrict or modify any part of the website
for:

  • Maintenance;
  • Security updates;
  • Technical improvements;
  • Service provider changes;
  • Legal or regulatory reasons; or
  • Events outside our reasonable control.

We are not responsible for losses caused solely by temporary website
unavailability where we have taken reasonable steps to operate and
restore the service.

5. Product Information

We take reasonable care to ensure that product descriptions, images,
dimensions, materials and prices are accurate.

However, the following minor differences may occur:

  • Colours may appear differently depending on your screen, device,
    brightness settings and display calibration;
  • Printed colours may vary slightly from colours shown on a digital
    screen;
  • Product dimensions may be subject to small manufacturing tolerances;
  • Natural wood frames may contain minor variations in colour, grain
    and texture;
  • The positioning or cropping of an artwork may vary slightly between
    different print sizes or aspect ratios; and
  • Room mock-ups are provided for styling and scale guidance and may not
    represent exact dimensions.

These minor variations do not affect your statutory rights where a
product is faulty, damaged, materially different from its description
or otherwise does not conform to applicable consumer law.

Frames, mounts, hanging accessories and decorative objects shown in
lifestyle images are not included unless expressly stated in the
product description.

6. Product Availability

All products are subject to availability.

Adding a product to your shopping cart does not reserve the product or
guarantee its availability.

We may limit the quantity of a product that can be purchased in a
single order or by a single customer.

If a product becomes unavailable after you place an order, we will
contact you and offer, where appropriate:

  • A replacement product;
  • A revised delivery estimate;
  • A partial refund; or
  • A full refund for the unavailable product.

7. Personalised and Made-to-Order Products

Certain Inkwallart products may be personalised, customised or produced
according to information provided by you.

Personalisation may include:

  • Names and initials;
  • Dates and locations;
  • Coordinates;
  • Personal messages;
  • Colour selections;
  • Custom dimensions;
  • Customer-supplied photographs; or
  • Other customer-specific instructions.

You are responsible for checking all spelling, dates, names, image
quality, colours, dimensions and other personalisation details before
submitting your order.

We are not responsible for errors that appear in the finished product
where those errors were included in the information approved or
submitted by you.

We may contact you if submitted information is unclear, incomplete,
technically unsuitable or potentially unlawful. Production and delivery
times may be affected until we receive the required response.

We reserve the right to refuse personalisation requests that:

  • Are unlawful, threatening, discriminatory or abusive;
  • Infringe intellectual property or privacy rights;
  • Include content we reasonably consider obscene or harmful;
  • Impersonate or misrepresent another person or organisation;
  • Contain malicious code or technically unsafe files; or
  • Could expose Inkwallart or another person to legal liability.

Custom-made or clearly personalised products may not qualify for a
change-of-mind cancellation or return where an applicable legal
exception applies.

This does not affect your rights where a personalised product is
faulty, damaged, incorrectly produced or materially different from the
approved order details.

8. Customer-Supplied Images and Content

If you upload or submit photographs, text, illustrations, designs or
other content for a personalised product, you confirm that:

  • You own the content or have permission to use it;
  • You have permission from identifiable people shown in the content;
  • The content does not infringe copyright, trademark, privacy or other rights;
  • The content is lawful and does not contain prohibited material; and
  • We may use the content to process and fulfil your order.

You retain ownership of the content you submit.

You grant Inkwallart and its production, hosting and fulfilment
providers a limited, non-exclusive licence to store, reproduce, edit,
crop and process the content only as reasonably necessary to:

  • Create the requested product;
  • Provide a preview;
  • Complete quality control;
  • Deliver the order;
  • Handle a complaint, reprint or refund; and
  • Comply with legal obligations.

We will not use customer-supplied personalised content for advertising
or public promotional purposes without obtaining additional permission.

8A. Design Studio and AI-Generated Artwork

Our design studio lets you upload your own images and, where offered, create or enhance artwork with artificial intelligence (“AI”) tools provided by third-party technology providers.

When you use the AI tools:

  • You are responsible for the descriptions (prompts) and images you submit, and they must follow section 8 and the acceptable use rules in section 25;
  • You must not ask for content that copies or imitates protected characters, brands, logos, trademarks or the work of identifiable artists, or that depicts real people without their permission;
  • Prompts, uploaded images and results are checked automatically, and we may refuse, remove or not print content that we reasonably consider unlawful, harmful, infringing or unsuitable;
  • AI results are generated automatically. Similar prompts can produce similar results for other users, so we do not guarantee that a result is unique, or that it is free of resemblance to existing works; and
  • Results may contain imperfections (for example in text, hands or fine detail). You will see a preview before ordering, and you should check it carefully.

Subject to these Terms and to the terms of our technology providers, you may use AI artwork created for you for your personal, non-commercial purposes, including ordering prints of it. To the extent we hold any rights in that artwork, we grant you a non-exclusive licence for those purposes. Intellectual property protection for AI-generated material is limited in many countries, and we do not promise that you can register or enforce rights in it.

You grant us the same limited licence for AI artwork created for you as for content you upload (section 8), so that we can store, preview, produce and deliver your order. We will not use your designs for advertising or public promotion without your additional permission.

To make prints sharper, we may enlarge (upscale) images with AI before printing. This is included in the product price.

8B. Design Credits

Some AI features use design credits. Credits are a prepaid licence to use those features on this website; they are not money, a deposit, a gift card or a stored-value product.

  • Paid credits are bought in packs. The number of credits each feature uses is shown before you use it.
  • Bonus credits may be given free of charge, for example after you confirm your email address or after a completed order. We may change or end bonus offers at any time; bonus credits have no monetary value.
  • Using credits as a discount: where the checkout offers it, unused paid credits can be applied as a discount on prints, at the value per credit shown at checkout. This value may be lower than the price you paid per credit. Bonus credits cannot be used as a discount.
  • Credits cannot be exchanged for cash, transferred to another account or resold, except where the law requires otherwise.
  • If an AI request fails or its result is rejected by our content checks, the credits used for it are returned to your balance automatically.
  • Credit packs are digital content supplied immediately. Where the law gives you a right to cancel, you agree, when buying, that supply starts at once, and you acknowledge that you lose the right to cancel once you have started using the credits. Unused credit packs may be refunded on request within 14 days of purchase.
  • We may suspend credits or close an account where credits were obtained or used fraudulently or in breach of these Terms.
  • If we permanently close the design studio, we will give reasonable notice so that you can use your remaining paid credits, or we will refund unused paid credits.

9. How Orders Are Placed

Before placing an order, you will have an opportunity to review and
correct the products, quantities, personalisation details, delivery
information and price.

To place an order, you must complete the checkout process and select
the button that confirms an obligation to pay.

After your order is submitted, we will send an acknowledgement email.
This acknowledgement confirms that we have received your order but does
not necessarily mean that the order has been accepted.

A contract between you and Inkwallart is formed when we:

  • Send an order acceptance or dispatch confirmation; or
  • Begin production of a personalised or made-to-order product,

whichever occurs first.

If we cannot accept your order, we will notify you and refund any
payment already taken for that order.

10. Reasons We May Refuse or Cancel an Order

We may refuse or cancel an order before fulfilment where:

  • The product is unavailable;
  • Payment cannot be authorised;
  • We suspect fraud or unauthorised payment activity;
  • There is an obvious pricing or product description error;
  • A delivery location is not supported;
  • The order exceeds applicable quantity limits;
  • The personalisation request breaches these Terms;
  • We are unable to produce the requested customisation;
  • You have materially breached these Terms; or
  • We are legally prohibited from completing the transaction.

If we cancel an accepted order, we will refund the amount paid for the
cancelled products unless we are legally entitled to withhold an amount.

11. Prices

Product prices are displayed in the currency selected or assigned on
the website.

Prices may change at any time, but changes will not normally affect
orders already accepted.

Unless otherwise stated:

  • Delivery charges are calculated separately at checkout;
  • Applicable taxes may be included or calculated at checkout;
  • Customs duties and import charges may apply to international orders;
  • Currency conversion charges may be applied by your payment provider; and
  • Promotional prices are available only during the stated period.

The final amount payable will be displayed before you submit the order.

If a product is listed at an obviously incorrect price, we are not
required to supply it at that price where the error should reasonably
have been recognised as a mistake.

In that situation, we may contact you to confirm whether you wish to
purchase the product at the correct price or cancel the order and issue
a refund.

12. Taxes, Customs and Import Charges

The tax treatment of your order depends on the product, delivery
destination, order value and location from which the product is
dispatched.

Where the website states that duties and taxes are included, the amount
shown at checkout will include the applicable charges identified by us.

Where duties and taxes are not included, you may be responsible for:

  • Import VAT;
  • Customs duties;
  • Brokerage charges;
  • Carrier administration fees; and
  • Other charges imposed by the destination country.

You are responsible for providing information required by customs
authorities and paying charges for which you are legally responsible.

Customs procedures may cause delays that are outside our reasonable
control.

13. Payment

Available payment methods will be shown during checkout.

Payments may be processed by independent payment service providers.
Their separate terms and privacy policies may apply.

You authorise us and our payment providers to charge the total order
amount to your selected payment method.

We may use fraud prevention and payment verification tools before
accepting or dispatching an order.

We do not generally store complete payment card details. Payment
information is normally collected and processed by the relevant
payment provider.

14. Discount Codes and Promotions

Discount codes and promotional offers:

  • Must be used within the stated validity period;
  • May be limited to specified products, customers or countries;
  • May require a minimum order value;
  • Cannot normally be exchanged for cash;
  • Cannot normally be combined unless expressly stated;
  • May exclude delivery charges, taxes and gift cards; and
  • May be limited to one use per customer or household.

We may cancel or refuse a discount where it has been obtained, shared
or used fraudulently, unlawfully or contrary to the promotion terms.

15. Shipping and Delivery

Available delivery methods, estimated delivery times and shipping costs
will be displayed during checkout or in our
Shipping and Delivery Policy.

Delivery estimates are not guaranteed delivery dates unless expressly
stated otherwise.

Production and delivery times may vary for:

  • Personalised products;
  • Made-to-order products;
  • Large-format products;
  • Framed products;
  • Orders containing multiple products;
  • Remote delivery locations; and
  • Orders affected by customs procedures.

You must provide a complete and accurate delivery address.

We are not responsible for delays or failed delivery caused by an
incomplete or incorrect address supplied by you. Additional shipping
charges may apply if an order must be resent.

If your order is delayed, lost or arrives damaged, contact
[email protected]
as soon as reasonably possible.

16. Split Shipments

Products in the same order may be produced or dispatched from different
locations.

We may therefore deliver an order in more than one shipment. Where
possible, tracking information will be provided for each shipment.

You will not normally be charged additional delivery fees solely
because we choose to split an order after checkout.

17. Risk and Ownership

Responsibility for loss of or damage to physical products passes to you
when the products are delivered to:

  • You;
  • A person identified by you to receive them; or
  • Another location expressly authorised by you.

Ownership of products passes to you after we have received full payment
and the products have been delivered, unless applicable law requires
otherwise.

18. Cancelling an Order Before Dispatch

Contact us as soon as possible if you wish to cancel or change an order.

We may be able to cancel or amend a standard product order before it is
dispatched, but we cannot guarantee that changes will be possible.

Personalised and made-to-order products may enter production shortly
after the order is placed. Once production has started, cancellation or
amendment may not be possible.

This section does not limit any mandatory cancellation rights available
under applicable consumer law.

19. Consumer Right to Cancel

If you are a consumer in the United Kingdom, European Economic Area or
another jurisdiction that provides a statutory cooling-off period, you
may have the right to cancel an eligible distance purchase without
giving a reason.

Where a 14-day cancellation right applies to physical goods, the
cancellation period generally expires 14 days after the day on which
you, or a person nominated by you, receives the goods.

To exercise this right, you must clearly notify us of your decision to
cancel before the cancellation period expires.

You can contact:

Inkwallart Customer Support
Email:
[email protected]
Address: [RETURNS OR BUSINESS ADDRESS]

You may use the cancellation form included in our
Returns and Refunds Policy,
but using that form is not mandatory.

Where cancellation rights apply, you must normally return the products
within 14 days after informing us of the cancellation.

You are responsible for handling the products only to the extent
reasonably necessary to inspect their nature, characteristics and
function. We may make a lawful deduction from a refund where the value
of a returned product has been reduced by unnecessary handling.

20. Exceptions to Change-of-Mind Cancellation

A statutory or voluntary change-of-mind cancellation right may not
apply to:

  • Products made to your specifications;
  • Clearly personalised products;
  • Custom-sized prints or frames;
  • Products produced using customer-supplied photographs or text;
  • Sealed products that are not suitable for return for health or hygiene reasons once unsealed, where legally applicable;
  • Digital content supplied immediately with your prior consent, where legally applicable; or
  • Other products excluded by applicable law.

This exception does not apply where the product is faulty, damaged,
incorrectly produced or does not match the agreed description.

21. Returns and Refunds

Returns must be made in accordance with our
Returns and Refunds Policy.

Unless the product is faulty or we agree otherwise, you may be
responsible for the direct cost of returning an eligible
change-of-mind return.

Products should be securely packaged to prevent damage during return.

Where a refund is due, we will normally issue it to the original
payment method unless:

  • You expressly agree to another method;
  • The original payment method is no longer available; or
  • Applicable law requires another process.

Refund processing times may vary depending on the payment provider.

22. Faulty, Damaged or Incorrect Products

Products must comply with applicable consumer protection law.
Depending on your location, this may include requirements that products
are:

  • As described;
  • Of satisfactory or acceptable quality;
  • Fit for their usual or agreed purpose; and
  • Free from material defects.

Contact us promptly if a product:

  • Arrives damaged;
  • Contains a manufacturing defect;
  • Is materially different from the product ordered;
  • Was personalised incorrectly by us; or
  • Is missing from the delivery.

We may request:

  • Your order number;
  • A description of the issue;
  • Photographs of the product;
  • Photographs of the packaging and shipping label; and
  • Other information reasonably required to investigate the claim.

Depending on the circumstances and applicable law, we may offer:

  • A repair;
  • A replacement;
  • A reprint;
  • A price reduction;
  • A partial refund; or
  • A full refund.

Nothing in these Terms excludes or limits your mandatory statutory
rights.

23. Frames, Installation and Product Care

You are responsible for choosing suitable fixings, tools and
installation methods for your wall type, frame weight and property.

Hanging accessories supplied with a product may not be suitable for
every wall or installation environment.

Where appropriate, installation should be completed or checked by a
competent adult or professional installer.

To reduce the risk of damage:

  • Do not hang products above a bed or cot without appropriate secure fixings;
  • Keep glass and framed products away from unstable surfaces;
  • Keep packaging materials away from young children;
  • Avoid prolonged exposure to direct sunlight, heat or excessive moisture;
  • Follow any care instructions supplied with the product; and
  • Check wall fixings periodically.

Nothing in this section limits liability that cannot lawfully be
excluded.

24. Customer Accounts

You may be able to create an account to view orders, save addresses,
manage preferences or use other website features.

You are responsible for:

  • Providing accurate account information;
  • Keeping login credentials confidential;
  • Restricting access to your account and device; and
  • Informing us promptly of suspected unauthorised access.

We may suspend or close an account where we reasonably believe:

  • The account has been compromised;
  • False information has been provided;
  • The account is being used fraudulently or unlawfully;
  • The user has seriously or repeatedly breached these Terms; or
  • Suspension is necessary to protect customers or the website.

25. Acceptable Use

You must not:

  • Use the website for unlawful or fraudulent purposes;
  • Attempt to gain unauthorised access to the website, accounts or systems;
  • Introduce viruses, malicious code or harmful technologies;
  • Interfere with the security or operation of the website;
  • Use automated tools to scrape, copy or extract website content without permission;
  • Attempt to bypass purchase limits or security controls;
  • Use another person’s identity or payment details without authorisation;
  • Submit content that infringes another person’s rights;
  • Use the website to distribute spam or unsolicited commercial messages; or
  • Use Inkwallart content to train, develop or improve an artificial intelligence or machine-learning system without our written permission.

We may take reasonable technical or legal action in response to misuse
of the website.

26. Intellectual Property

Unless otherwise stated, the website and its contents are owned by or
licensed to Inkwallart.

Protected content may include:

  • Artwork and illustrations;
  • Photographs and product images;
  • Product names and collection names;
  • Logos and trademarks;
  • Website design and layout;
  • Text and editorial content;
  • Graphics and icons;
  • Videos and animations;
  • Software and source code; and
  • Digital previews and mock-ups.

Purchasing a physical print or framed product gives you ownership of
that physical item. It does not transfer copyright or other
intellectual property rights in the artwork.

Unless we provide written permission, you may not:

  • Reproduce or copy artwork;
  • Create derivative products;
  • Digitise or redistribute prints;
  • Use artwork commercially;
  • Sell copies or reproductions;
  • Upload artwork to print-on-demand services;
  • Remove copyright, trademark or ownership notices; or
  • Use product images for commercial advertising.

This section covers artwork and other content we provide. It does not apply to images you upload or AI artwork created for you in our design studio, which are covered by sections 8 and 8A.

You may use a purchased physical product for normal personal,
residential or workplace display.

27. Reviews and Other Public Submissions

You may be able to submit product reviews, comments, photographs or
other public content.

You retain ownership of content you submit. By publishing public
content through the website or sending it to us for publication, you
grant Inkwallart a non-exclusive, worldwide, royalty-free licence to:

  • Host and display the content;
  • Reproduce and format it;
  • Moderate or shorten it without changing its meaning;
  • Use it to promote the relevant product or Inkwallart; and
  • Share it through our website, emails and social media channels.

This licence continues for as long as the content is used in connection
with the website or our marketing, unless applicable law gives you the
right to withdraw it.

You confirm that public content:

  • Reflects your genuine experience;
  • Is accurate to the best of your knowledge;
  • Does not contain confidential or sensitive information;
  • Does not infringe another person’s rights;
  • Is not unlawful, defamatory, abusive or misleading; and
  • Does not contain undisclosed paid endorsements.

We may remove or refuse content that breaches these Terms, applicable
law or our moderation standards.

28. Third-Party Links and Services

The website may contain links to third-party websites, social networks,
payment providers or other external services.

Those services are operated independently and may be subject to their
own terms and privacy policies.

We are not responsible for the content, availability, security or
practices of third-party services, except where responsibility cannot
lawfully be excluded.

29. Privacy

We process personal information in accordance with our
Privacy Policy.

Information about cookies and similar technologies is available in our
Cookie Policy.

30. Events Outside Our Reasonable Control

We are not responsible for delay or failure caused by circumstances
outside our reasonable control.

These circumstances may include:

  • Natural disasters;
  • Severe weather;
  • Fire or flood;
  • War, terrorism or civil disturbance;
  • Government action;
  • Customs delays;
  • Transport or postal disruption;
  • Labour disputes;
  • Utility, internet or telecommunications failures;
  • Cyberattacks affecting third-party infrastructure;
  • Epidemics or public health emergencies; or
  • Failure of suppliers despite reasonable contingency measures.

We will take reasonable steps to reduce the effect of the event and
resume performance where possible.

31. Our Responsibility to Consumers

We are responsible for foreseeable loss or damage caused by our breach
of these Terms or failure to use reasonable care and skill.

Loss or damage is foreseeable if it was an obvious consequence of the
breach or if both parties knew it might occur when the contract was
formed.

We do not exclude or limit liability where doing so would be unlawful,
including liability for:

  • Death or personal injury caused by negligence;
  • Fraud or fraudulent misrepresentation;
  • Deliberate misconduct;
  • Breach of mandatory consumer rights; or
  • Any other liability that cannot legally be excluded.

We are not responsible for losses that result from:

  • Your misuse of a product;
  • Your failure to follow installation or care instructions;
  • Incorrect personalisation information submitted by you;
  • Unauthorised alterations to a product;
  • Events outside our reasonable control; or
  • Business losses arising from a consumer purchase.

32. Business Customers

If you purchase products wholly or mainly for business purposes, you
confirm that you have authority to bind the relevant business.

Business, wholesale, trade, hospitality, interior design and commercial
project orders may be subject to separate written terms.

Unless mandatory law provides otherwise, consumer cancellation rights
do not apply to purchases made wholly or mainly for business purposes.

For business customers, and to the fullest extent permitted by law, we
will not be liable for:

  • Loss of profit;
  • Loss of revenue;
  • Loss of business opportunity;
  • Loss of anticipated savings;
  • Loss of goodwill; or
  • Indirect or consequential loss.

Any additional limitation of liability for business orders should be
stated in the applicable trade or project agreement.

33. Complaints

We aim to resolve complaints fairly and promptly.

appropriate certified alternative dispute resolution provider.

We are not currently committed to using any specific alternative
dispute resolution provider unless stated here:

34. Governing Law and Courts

These Terms and contracts formed through the website are governed by
the laws of:

[ENGLAND AND WALES / RELEVANT EU MEMBER STATE]

If you are a consumer, this choice of law does not deprive you of any
mandatory consumer protection rights available under the laws of the
country in which you habitually reside.

Consumers may bring legal proceedings in any court that has
jurisdiction under applicable consumer law, including, where
applicable, the courts of their country of residence.

If you are a business customer, the courts of[ENGLAND AND WALES / RELEVANT EU MEMBER STATE] will have exclusive
jurisdiction, unless a separate written agreement states otherwise.

35. Assignment

We may transfer our rights and obligations under these Terms to another
organisation as part of a restructuring, sale, merger or transfer of
our business.

Any transfer will not reduce the mandatory rights of consumers.

You may not transfer your rights or obligations under an order without
our written consent, except where applicable law permits you to do so.

36. Severability

If any provision of these Terms is found to be unlawful, invalid or
unenforceable, that provision will be treated as modified to the
minimum extent necessary or removed where modification is not possible.

The remaining provisions will continue in effect.

37. No Waiver

If we delay or fail to enforce a provision of these Terms, this does
not mean that we have waived our right to enforce it later.

38. Entire Agreement

These Terms, together with the policies referenced in them and any
order-specific information shown at checkout, form the agreement
between you and Inkwallart concerning your use of the website and
purchase.

Nothing in this section excludes liability for fraud or prevents a
consumer from relying on mandatory legal rights.
