3. Scope of the Agreement
This Agreement applies to products ordered through the Inkwallart

The website may be used by consumers and business customers. Certain
statutory rights described in this Agreement apply only to consumers.
Separate commercial terms may apply to:
- Wholesale purchases;
- Trade accounts;
- Interior design projects;
- Hospitality or corporate projects;
- Large-volume orders; and
- Custom business commissions.
4. Pre-Contract Information

applicable or omitted.
6. Electronic Acceptance
The Agreement is concluded electronically.
By selecting the final checkout button confirming that the order
creates an obligation to pay, the customer:
- Confirms that the order information is correct;
- Accepts the total price and applicable charges;
- Agrees to this Distance Sales Agreement;
- Agrees to the Terms of Service;
- Acknowledges the applicable return and cancellation conditions;
- Confirms authority to use the selected payment method; and
- Requests that the seller process the order.
A copy of the order confirmation and the applicable contractual
information will be provided electronically or made available through
the customer’s account.
7. Formation of the Contract
Submission of an order constitutes an offer by the customer to purchase
the selected products.
An automated order-received email confirms receipt of the order but
does not necessarily constitute acceptance.
The contract is formed when the seller:
- Sends an order acceptance or dispatch confirmation; or
- Begins production of a personalised or made-to-order product,
whichever occurs first.
If the seller cannot accept the order, the customer will be notified and
any payment collected for the rejected order will be refunded.
8. Product Characteristics
The main characteristics of each product are described on the relevant
product page.
Depending on the product, the description may include:
- Artwork title;
- Print dimensions;
- Orientation;
- Paper or material type;
- Printing method;
- Frame material and colour;
- Mount or passepartout information;
- Personalisation options;
- Hanging accessories;
- Care instructions; and
- Production location.
Digital displays, screen settings and lighting conditions may cause
colours to appear slightly different from the physical product.
Minor variations may also occur because of printing tolerances, paper
texture, natural wood grain or the adaptation of artwork to different
size ratios.
Such minor variations do not affect the customer’s mandatory rights
where a product is faulty, materially different from its description or
otherwise non-conforming.
9. Personalised and Made-to-Order Products
The customer must carefully review all personalisation details before
placing an order.
This includes:
- Names;
- Spelling;
- Dates;
- Coordinates;
- Locations;
- Custom messages;
- Photographs;
- Image resolution;
- Selected colours;
- Dimensions; and
- Other customer instructions.
The seller is not responsible for an error reproduced accurately from
information submitted or approved by the customer.
The seller may contact the customer if submitted information or content
is incomplete, unclear, unlawful or technically unsuitable.
Production and delivery may be delayed until the required information
or approval is received.
10. Prices
The customer must pay the total price displayed at checkout.
The total price may include:
- The product price;
- Personalisation charges;
- Framing charges;
- Shipping charges;
- Applicable VAT, sales tax or similar taxes;
- Import duties collected in advance; and
- Any other charge clearly disclosed before the order is placed.
The price displayed in the order confirmation will apply to the
accepted order.
If a clear and obvious pricing error occurs, the seller may contact the
customer to offer the product at the correct price or cancel the
affected item and issue a refund.
11. Taxes, Customs and Import Charges
International orders may be subject to VAT, sales tax, import tax,
customs duty, brokerage fees or carrier administration charges.
Where the checkout clearly states that taxes and duties are included,
the seller or its service provider will arrange payment of the charges
identified at checkout.
Where the checkout states that duties or import charges are not
included, the customer may be required to pay those charges directly
to the relevant authority or delivery provider.
The customer is responsible for complying with the import rules of the
delivery country and supplying any information reasonably requested by
customs authorities.
12. Payment
Available payment methods are displayed at checkout.
Payments may be processed by independent payment service providers and
may be subject to their own terms.
By submitting the order, the customer authorises the total amount to be
charged to the selected payment method.
The seller may use payment verification and fraud prevention systems.
An order may be suspended or cancelled if:
- Payment is declined;
- Payment information cannot be verified;
- Fraud or unauthorised use is reasonably suspected; or
- The payment provider requires additional verification.
13. Production
Certain products are printed, framed, personalised or otherwise
produced after the order has been placed.
Estimated production times will be displayed on the product page,
during checkout or in the order confirmation.
Production times may vary due to:
- Product type and size;
- Personalisation requirements;
- Customer approval delays;
- Seasonal order volumes;
- Material availability;
- Quality-control requirements; or
- Events outside the seller’s reasonable control.
14. Delivery
Products will be delivered to the address provided by the customer
during checkout.
The customer must provide a complete and accurate address, including
any required apartment number, postal code, access instructions and
recipient information.
Delivery estimates are not guaranteed dates unless expressly identified
as guaranteed.
Products in the same order may be dispatched separately and may arrive
on different dates.
If delivery is delayed, the seller will provide information and options
required under applicable law.
If an order cannot be dispatched within the promised period, the seller
may:
- Request the customer’s consent to a revised delivery period; or
- Cancel the affected product and issue a refund.
Further information is available in the
Shipping and Delivery Policy.
15. Failed Delivery and Incorrect Addresses
If delivery fails because of an inaccurate or incomplete address
supplied by the customer, the customer may be responsible for
reasonable additional delivery or return costs.
If an order is returned to the seller because it was not collected or
accepted, the seller may contact the customer to arrange:
- Redelivery at the customer’s cost;
- A refund less permitted delivery and return costs; or
- Another reasonable solution.
These deductions will not apply where the failure was caused by the
seller or delivery provider.
16. Transfer of Risk
For consumer purchases, responsibility for loss of or damage to a
product passes to the customer when the product is physically delivered
to:
- The customer;
- A person identified by the customer to receive it; or
- A delivery location expressly authorised by the customer.
If the customer independently appoints a carrier not offered by the
seller, risk may pass when the product is delivered to that carrier,
where permitted by applicable law.
17. Ownership
Ownership of a physical product passes to the customer after:
- The seller has received full payment; and
- The product has been delivered,
unless applicable law requires otherwise.
Purchase of a physical print does not transfer copyright or other
intellectual property rights in the artwork.
18. UK and European Right of Withdrawal
If the customer is a consumer in the United Kingdom, European Economic
Area or another country providing an equivalent statutory right, the
customer may have the right to withdraw from an eligible distance
contract without giving a reason.
For eligible physical products, the withdrawal period generally expires
14 days after the day on which the customer, or a person nominated by
the customer, receives the product.
If multiple products ordered together are delivered separately, the
period generally begins after the last eligible product is received.
To exercise the right of withdrawal, the customer must send a clear
statement before the withdrawal period expires.
The statement may be sent to:
Inkwallart Customer Support[COMPANY LEGAL NAME]
[WITHDRAWAL OR RETURNS ADDRESS]
Email:
[email protected]
The customer may use the model withdrawal form included at the end of
this Agreement, but use of the form is not mandatory.
19. Returning Products After Withdrawal
Where the statutory withdrawal right applies, the customer must return
the products without undue delay and normally no later than 14 days
after notifying the seller of the withdrawal.
The return deadline is met if the products are sent before the relevant
14-day period expires.
Unless the seller agrees otherwise or the product is faulty, the
customer is responsible for the direct cost of returning the product.
The customer should:
- Package the product securely;
- Include the order number;
- Use a trackable delivery method where appropriate;
- Retain proof of dispatch; and
- Follow the return instructions provided by the seller.
20. Refunds Following Withdrawal
Where the customer validly exercises a statutory right of withdrawal,
the seller will refund eligible payments received from the customer.
The refund will include the cost of the least expensive standard
delivery method offered by the seller, where required by applicable
law.
Additional delivery costs resulting from the customer selecting a more
expensive delivery method may not be refundable.
The seller may withhold the refund until:
- The returned products have been received; or
- The customer provides evidence that the products have been sent back,
whichever occurs first, where permitted by applicable law.
Refunds will normally be issued using the original payment method unless
the customer expressly agrees otherwise.
21. Reduction in Value
The customer may inspect an eligible product in a manner reasonably
necessary to establish its nature, characteristics and functioning.
Where permitted by law, the seller may deduct an amount from the refund
if the product’s value has been reduced because it was handled beyond
what would reasonably be permitted when inspecting it in a physical
shop.
Examples of excessive handling may include:
- Damaging or marking a print;
- Removing protective film unnecessarily;
- Installing or hanging the product;
- Damaging a frame or mount;
- Returning incomplete components; or
- Using packaging in a way that causes avoidable product damage.
22. Exceptions to the Right of Withdrawal
The statutory change-of-mind withdrawal right may not apply to products
that are:
- Made to the customer’s specifications;
- Clearly personalised;
- Printed using customer-supplied photographs or text;
- Produced in a custom size selected by the customer;
- Custom-framed or custom-mounted;
- Made using customer-selected bespoke colour combinations;
- Altered specifically at the customer’s request; or
- Otherwise legally excluded from the withdrawal right.
This exception does not remove the customer’s rights where the product
is faulty, damaged, incorrectly produced or materially different from
the agreed specifications.
23. United States Change-of-Mind Returns
Customers in the United States do not automatically receive the UK or
European statutory 14-day withdrawal right solely because an order was
placed online.
Change-of-mind returns for United States customers are governed by the
Inkwallart
Returns and Refunds Policy
and any mandatory federal or state consumer law.
Personalised and made-to-order products are not eligible for
change-of-mind returns unless expressly stated otherwise.
24. Faulty, Damaged or Incorrect Products
The customer should contact the seller promptly if a product:
- Arrives damaged;
- Contains a manufacturing defect;
- Is materially different from its description;
- Is the wrong product;
- Was personalised incorrectly by the seller; or
- Is incomplete or missing from the delivery.
The seller may request:
- The order number;
- A description of the issue;
- Photographs of the product;
- Photographs of the packaging;
- Photographs of the shipping label; and
- Other information reasonably required to investigate the issue.
Depending on applicable law and the circumstances, the remedy may
include:
- Repair;
- Replacement;
- Reprinting;
- A price reduction;
- A partial refund;
- A full refund; or
- Reimbursement of reasonable return costs.
Nothing in this Agreement limits mandatory consumer rights relating to
faulty or non-conforming products.
25. Order Cancellation Before Dispatch
The customer should contact the seller immediately if they wish to
cancel or modify an order before dispatch.
Standard product orders may be cancelled before dispatch where
operationally possible.
Personalised or made-to-order products may enter production shortly
after the order is placed. Once production begins, the seller may be
unable to cancel or modify the product.
This section does not limit any mandatory statutory cancellation right.
26. Customer-Supplied Content
Where the customer submits text, photographs, illustrations or other
content, the customer confirms that:
- The customer owns the content or has permission to use it;
- The content does not infringe intellectual property rights;
- The content does not unlawfully infringe privacy rights;
- Permission has been obtained from identifiable persons where required;
- The content is lawful; and
- The seller may process the content to fulfil the order.
The customer grants the seller and its relevant production and
fulfilment partners a limited licence to store, crop, adjust, reproduce
and print the content only as reasonably necessary to:
- Produce the ordered product;
- Provide a preview;
- Complete quality control;
- Deliver the order;
- Produce an authorised replacement; and
- Handle a complaint or refund.
Customer-supplied content will not be used in public advertising without
separate permission.
27. Intellectual Property
All intellectual property rights in Inkwallart artworks, product images,
website content, collection names, graphics, logos and designs remain
owned by or licensed to the seller.
Purchase of a physical product gives the customer ownership of that
physical item only.
Unless separately authorised in writing, the customer may not:
- Copy or reproduce the artwork;
- Create derivative products;
- Resell reproductions;
- Digitise and distribute the artwork;
- Upload it to a print-on-demand service;
- Use it in commercial advertising; or
- Use it to train or develop an artificial intelligence system.
28. Complaints
Complaints may be submitted to:
Inkwallart Customer Support[COMPANY LEGAL NAME]
[COMPLAINTS ADDRESS]
Email:
[email protected]
The complaint should include:
- The customer’s name;
- The order number;
- A description of the issue;
- The requested resolution; and
- Any relevant supporting photographs or documents.
The seller will investigate and respond within a reasonable period.
Where required by applicable law, information about an appropriate
alternative dispute resolution provider will be supplied.
ADR provider:
[ADR PROVIDER OR “NOT CURRENTLY APPLICABLE”]
29. Personal Data
Personal information collected in connection with an order will be
processed in accordance with the
Privacy Policy.
Information may be shared with service providers where necessary for:
- Payment processing;
- Fraud prevention;
- Printing and framing;
- Order fulfilment;
- Shipping and customs clearance;
- Customer support;
- Tax and accounting compliance; and
- Legal compliance.
30. Events Outside the Seller’s Reasonable Control
The seller is not responsible for delay or failure caused by events
outside its reasonable control.
Such events may include:
- Natural disasters;
- Severe weather;
- Fire or flood;
- War or civil disturbance;
- Government or customs action;
- Postal or transport disruption;
- Labour disputes;
- Public health emergencies;
- Utility or telecommunications failures;
- Cyberattacks affecting third-party infrastructure; or
- Material shortages outside the seller’s reasonable control.
The seller will take reasonable steps to minimise the effect and resume
performance.
If performance becomes impossible or is delayed beyond a legally
acceptable period, the customer may be entitled to cancel and receive a
refund for unfulfilled products.
31. Liability
The seller does not exclude or limit liability where exclusion or
limitation would be unlawful.
This includes liability for:
- Death or personal injury caused by negligence;
- Fraud or fraudulent misrepresentation;
- Deliberate misconduct;
- Breach of mandatory consumer rights; or
- Any other liability that cannot lawfully be excluded.
Subject to mandatory law, the seller is not responsible for loss caused
by:
- Incorrect personalisation information supplied by the customer;
- Failure to follow product care or installation instructions;
- Use of unsuitable wall fixings;
- Unauthorised alteration of a product;
- Customer misuse;
- Import restrictions not disclosed to the seller; or
- Events outside the seller’s reasonable control.
32. Governing Law
This Agreement is governed by the laws of:
[ENGLAND AND WALES / RELEVANT EU MEMBER STATE]
If the customer is a consumer, this choice of law does not deprive the
customer of mandatory consumer protections available under the law of
the country in which the customer habitually resides.
33. Jurisdiction
A consumer may bring proceedings in any court having jurisdiction under
applicable consumer law, including the courts of the consumer’s country
of residence where legally permitted.
For business customers, the courts of
[ENGLAND AND WALES / RELEVANT EU MEMBER STATE] will have exclusive
jurisdiction unless a separate written agreement states otherwise.
34. Severability
If a provision of this Agreement is held to be invalid, unlawful or
unenforceable, it will be modified to the minimum extent required or
removed where modification is not possible.
The remaining provisions will continue in effect.
35. Electronic Records
The seller may retain an electronic record of:
- The order;
- The version of this Agreement accepted by the customer;
- The checkout information;
- The order confirmation;
- Payment and delivery records;
- Customer communications; and
- Any cancellation, return or complaint.
The customer should retain the order confirmation and a copy of the
Agreement for future reference.
